Data Controller

This Privacy Policy is issued by Spark Games Ltd, a company registered in England and Wales (company no. 15379140) (“we”, “us”, “our”). We are the data controller responsible for your personal information processed in connection with this service. For any privacy-related enquiries, please contact us using the details at the bottom of this page.

Information We Collect

We collect information you provide directly to us when you:

  • Sign in with Google. Google sends us your name, email address and profile picture. We never see or receive your Google password, and we request no access to your Gmail, Drive, Contacts or any other Google service.
  • Use the Studio. The description of the app you want to build, and the previews generated from it.
  • Create an account or subscription
  • Make a purchase or payment
  • Contact our support team

This may include your name, email address, payment information, and usage data. We also record whether you have asked to receive product updates by email, and when you asked.

How We Use Your Information

  • Sign you in and keep your Studio available when you return
  • Generate the app preview you asked for (see AI Processing below)
  • Process your payments and subscriptions
  • Send you receipts and important service updates
  • Provide customer support
  • Improve our services
  • Prevent fraud and ensure security
  • Send you product updates and our newsletter — only if you have opted in

We do not sell your personal information, and we do not share it with third parties for their own marketing.

Our Lawful Bases

Under UK GDPR we must have a lawful basis for each use of your information. Ours are:

  • Contract — signing you in, running the Studio, and providing anything you have paid for.
  • Legitimate interests — keeping a record of who has signed up so we can operate and improve the service, and securing it against abuse. You may object to this at any time.
  • Consent — marketing emails, and nothing else. You give it by turning on “Product updates”, and you can withdraw it just as easily.
  • Legal obligation — keeping records we are required to keep, such as for tax.

Marketing Emails

Signing in does not subscribe you to anything. Marketing email is opt-in and off until you ask for it, either from the card shown in the Studio or from the “Product updates” switch in Dashboard → Settings. We record the fact and the time of that choice so we can evidence it.

If you opt in, we will send occasional emails about new templates, product updates and tips. You can withdraw consent at any time by turning the same switch off, by using the unsubscribe link in any email, or by contacting us. Withdrawing consent does not affect anything we sent before you withdrew it, and it does not close your account.

Service messages — receipts, security notices and changes to these policies — are not marketing and are sent regardless, because they are part of providing the service to you.

AI Processing

The Studio uses Google Gemini to turn the description you type into an app preview. What we send is the description itself and a list of app categories to choose from. We do not send your name, your email address or any other account detail along with it, and the model is only ever asked to pick a category and suggest a product name.

Please do not type confidential information, personal data about other people, or anything you would not want processed by a third-party AI provider into the Studio. Google processes this data as an independent provider under its own terms; see the Gemini API Additional Terms of Service.

The previews the Studio produces are illustrative mock-ups assembled from our own template catalogue. No decision with a legal or similarly significant effect on you is made by automated means.

Data Security

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction.

Data Retention

We retain your information for as long as your account is active or as needed to provide you services. You may request deletion of your data by contacting us.

If you opt in to marketing email, we keep your address and your consent record until you unsubscribe, and for a short period afterwards so that we can honour the unsubscribe. App descriptions typed into the Studio are kept only for as long as needed to generate and show you the preview.

Third-Party Services

We use the following third-party services:

  • Google: Authentication (sign-in), and Gemini for the Studio's app previews
  • Neon: Database hosting
  • Vercel: Website hosting and delivery
  • Bottled: Sending email, including the contact form and any newsletter you have opted in to
  • Pixabay: Stock imagery used to dress the generated previews

Some of these providers process data outside the UK. Where they do, transfers are covered by the UK International Data Transfer Addendum, the UK extension to the EU Standard Contractual Clauses, or an adequacy decision.

Your Rights

Under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, you have the right to:

  • Access your personal information (Subject Access Request)
  • Correct inaccurate or incomplete data
  • Request erasure of your data (“right to be forgotten”)
  • Restrict or object to processing of your data
  • Receive your data in a portable format
  • Opt-out of direct marketing communications at any time

To exercise any of these rights, please contact us at spark-apps.co. We will respond within one month as required by UK GDPR. You also have the right to lodge a complaint with the Information Commissioner's Office (ICO), the UK supervisory authority for data protection.

Cookies

We use essential cookies to maintain your session and authentication. We do not use tracking or advertising cookies.

Governing Law

This Privacy Policy is governed by the laws of England and Wales. Any disputes arising in connection with this policy shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to This Policy

We may update this privacy policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the "Last Updated" date.
